First Amendment - Religion
Hypo: Say a public school wants to put on a school holiday presentation, part of which includes the singing of holiday songs by the school choir. The songs are pre-approved by the administration and include: silent night, dreidel, rudolph, etc. (The videos/lyrics of the songs are posted below). Which songs should the students be allowed to sing? Do any of the songs violate the Free Exercise Clause? What about the Establishment Clause? Does the Lemon Test apply? If so, how?
